Terms of Service: The Phoenix Sports Playbook

Welcome to the Phoenix Sports Flex Model!
We are so glad you’re here. As a fiercely independent, local small business, we do things differently than the big corporate franchises. We know that raising kids is unpredictable, which is why we’ve thrown out rigid seasonal locks and replaced them with a model designed for real families.
These Terms of Service are our "rules of the field." We’ve kept them clear to ensure things remain fair, transparent, and stress-free. By using our website and purchasing credits, you agree to these guidelines.
1. The 100% Flex Credit System:
We operate on a flexible digital credit system. Instead of being locked into a specific day or season, you purchase digital credit bundles to book classes as they fit your schedule.
Credit Tiers:
40 Min Credit: For our younger athletes (ages 18 months to 5 years).
60 Min Credit: For our older athletes (ages 4 to 9 years).
All-Access Mix & Match: Can be used interchangeably for any age tier.
No Expiration:
Your digital Flex Credits never expire. They act as a digital wallet for your family.
Book Anywhere:
Credits can be used to book any class, anywhere, at any time across our approved locations (including Carlsbad, Oceanside, and Encinitas).
2. Cancellations & Refunds
Parent-Initiated Cancellations (The "Life Happens" Policy):
You can cancel any booked class up to 15 minutes prior to the start time directly in your online portal. Doing so triggers an instant, 100% credit refund back to your Phoenix Sports account, no questions asked. (Note: This is a credit refund to your digital wallet, not a cash refund to your credit card).
Exceptional Cash Refunds:
While our standard policy issues refunds as account credits, if you are experiencing out-of-the-ordinary circumstances—such as moving out of the area or military deployment—we will issue a full cash refund to your original payment method for any remaining unused credits.
Company-Initiated Cancellations (Go/No-Go Thresholds):
To ensure classes run safely, we require a minimum of 2 kids per class.
Morning Classes (Starting before 12:00 PM): Must have at least 2 kids booked by 9:00 PM the night prior.
Afternoon Classes (Starting at 3:00 PM or later): Must have at least 2 kids booked by 12:00 PM the same day.
If a class misses these thresholds, we will auto-cancel the class, refund the credit to your account, and notify you. If you do not receive a cancellation notification, the class is a GO!
3. Schedule Changes, Modifications & Force Majeure Flexibility works both ways! Phoenix Sports reserves the right to adjust schedules, locations, coaches, or formats, and to cancel classes for safety, weather, facility availability, or operational reasons.
Force Majeure:
We are not responsible for delays, interruptions, or cancellations caused by events beyond our reasonable control (e.g., severe weather, poor air quality, public health orders, facility closures, or acts of God).
If a schedule change or Force Majeure event directly impacts a class you have booked, we will return the credit to your account.
4. Protecting Our Community (Right to Refuse Service):
To protect our safe and welcoming environment, Phoenix Sports may deny participation, suspend, or remove a participant or parent/guardian from any program for safety reasons, disruptive behavior, or rule violations, at our sole discretion, without refund.
5. Rewards & Gamification:
Through our Awesome Athlete Card, your child earns a sticker for every class attended.
8 Classes: Earns on-field fireworks and an official certificate!
32 Classes: Unlocks a 20% discount on your next credit bundle.
40 Classes: Grants "VIP Phoenix Lifer" status (permanent 5% discount on future bundles).
(Rewards have no cash value and cannot be combined with other promotional offers unless explicitly stated).
6. Uniform & Equipment Policy Comfort First:
There are no mandatory, expensive uniform kits. Kids should wear whatever makes them comfortable and ready to play!
Required: Closed-toe sneakers.
Optional: Cleats and shin guards.
The Personalized Jersey Policy:
Every athlete receives their own personalized Phoenix Sports jersey! To keep our programs affordable and focus on the fun, we provide one free jersey for every 40 classes attended. If a jersey gets lost or becomes unwearable (because kids will be kids!), we happily provide one free replacement during that 40-class span. Any additional jerseys beyond that—or if you just want a backup—are available for purchase at $30 each.
Governing Law & Electronic Acceptance:
This Agreement is governed by the laws of the State of California, without regard to conflict-of-law rules. Any legal action must be filed in San Diego County, California. By checking an "I Agree" box, submitting registration, or permitting participation, you agree that this constitutes a legally binding signature and acceptance to the fullest extent permitted by law.
2. Activities Participation & Liability Release
Keeping Our Athletes Safe We require you to acknowledge the realities of playing on the field.
1. Assumption of Inherent Risks:
I understand that youth sports (including soccer, beach soccer, beach football, baseball, basketball, sensory and movement classes, sports fitness, and camps) involve inherent and unavoidable risks. These include, but are not limited to: slips/falls; collisions with other participants, coaches, equipment, or surfaces; overexertion; heat illness; concussions; sprains/strains; fractures; paralysis; and serious injury or death. I knowingly and voluntarily assume all inherent risks of participation.
2. Health Attestation & Medical Authorization:
I represent that my child (ages 18 months to under 18 years) is physically and mentally able to participate. In the event of an accident or emergency, I authorize Phoenix Sports and its representatives to obtain or provide emergency assistance and consent to medical treatment as deemed necessary by a licensed health care provider or EMS. Phoenix Sports will attempt to contact me, but treatment may be provided before contact is made if required. I accept full financial responsibility for all medical and related expenses.
3. Release of Liability & Covenant:
Not to Sue To the fullest extent permitted by law, I release and discharge Phoenix Sports, Inc., Douglas Goldfein, our coaches, location partners, and host cities (including the owners of facilities utilized for our programs) from any and all claims, demands, or liabilities (including attorneys' fees) arising out of my child's participation, whether caused by ordinary negligence or otherwise. I agree not to file or assist in filing any lawsuit against the Released Parties for any matter released by this Agreement.
4. Indemnification and Hold Harmless:
To the fullest extent permitted by law, I agree to defend, indemnify, and hold harmless the Released Parties from any claims, actions, or damages arising out of my child's participation, my conduct at any facility, or any breach of this Agreement.
5. Parent Code of Conduct I pledge to:
Place my child's well-being and sportsmanship above winning.
Treat players, coaches, staff, and other families with respect.
Refrain from profanity, harassment, or disruptive behavior.
Address concerns privately with staff before/after activities.
Create a tobacco, vape, and drug-free environment during events.
6. Acknowledgement & Electronic Signature:
I am the parent or legal guardian of the participating minor. I acknowledge that by toggling "YES" or checking the acceptance box during account completion and checkout, I am providing my electronic signature and agreeing to be bound by these terms to the fullest extent permitted by applicable law.
3. Media Release Form
Showing Off Our Awesome Athletes By accepting these terms, I grant Phoenix Sports, Inc. and its affiliates permission to capture my child’s likeness (photo/video/audio) during activities and to use such media for lawful educational, promotional, and informational purposes (including our website, social media, and flyers) without compensation.
Privacy Matters:
We are fiercely protective of your child's privacy. We will never use your child’s name or personal identifying information in our marketing. While we do our absolute best to blur or avoid capturing names printed on the backs of jerseys, we cannot completely guarantee a jersey name won't occasionally appear in an action shot. By agreeing, you consent to the possible, unintentional use of a jersey name in promotional content.
Opting Out: If you wish to allow participation but opt out of marketing uses, please email us before your first session. We will happily make reasonable efforts to honor opt-out requests but cannot guarantee exclusion from wide group images.
I acknowledge that by toggling "YES" or checking the acceptance box during account completion and checkout, I am providing my electronic signature and agreeing to this media release.
4. Email, Text & Communication Consent
Keeping You in the Loop (Without the Spam) Communication is key to keeping the Flex system running smoothly. By creating an account, you consent to receive email and SMS text messaging communications from Phoenix Sports, Inc. and its authorized communication partners.
What We Will Send:
Vital Account Info: Booking confirmations, instant refund alerts, and credit updates.
Game-Day Alerts: Go/No-Go notifications, weather updates, and field changes.
Community News: Milestones, local events, and special discounts.
Important Disclaimer Regarding Text Messages:
Please note that Phoenix Sports staff (including owner Douglas Goldfein) will occasionally send SMS text messages from personal phone numbers. These messages are purely for vital program updates and customer service (e.g., a coach running late, a missed class check-in, or schedule adjustments) and are not used for automated marketing.
Opting Out: You can unsubscribe from marketing emails at any time by clicking the "unsubscribe" link. You may opt out of SMS messages by replying STOP. (Please note:
Even if you opt out of marketing communications, you acknowledge that you will still receive vital transactional messages regarding class cancellations or account credits).
I ACKNOWLEDGE THAT BY TOGGLING "YES" OR CHECKING THE ACCEPTANCE BOX DURING ACCOUNT COMPLETION AND CHECKOUT, I AM PROVIDING MY ELECTRONIC CONSENT AND AGREEING TO THESE COMMUNICATION TERMS.
